Exempt or Non-Exempt?

Join us the afternoon of December 10th for an exclusive half-day pre-conference workshop on properly classifying employees as exempt or non-exempt—a notoriously tricky area for employers.

It's difficult to review a job description and know whether that position is exempt or non-exempt. A good assessment requires a review of the employee's job duties, responsibilities, education, etc. It's also difficult to draft a job description from scratch and get it to say what you want it to. You want to make sure that workers who should be receiving overtime are in fact doing so, without unnecessarily paying it out to workers who should be classified as exempt. The job description, of course, is a big factor in proper classification. Getting an employee's status wrong—including drafting a bad job description—can cost you big in terms of lawsuits and back pay.

In our workshop, we'll discuss and analyze the employee positions about which you have questions on exempt or nonexempt status, as well as learn how to draft solid, accurate descriptions. We'll also discuss the importance of having employees perform the duties listed in the job description.

You'll also have the opportunity to submit your own job descriptions ahead of time--the ones you're not sure about, that seem like they could go either way, that have been giving you headaches. Our experts will review them all and discuss a representative sampling at the workshop so that you can learn how the principles of smart drafting apply to real-life situations.
